Terms and Conditions

Last updated: October 15, 2026

We are Aleh Hutnikau (“Company,” “we,” “us,” “our”), a sole proprietorship (Einzelunternehmen) established in Germany at Schmidener Str. 216C, Stuttgart, BW 70374. “Company” is only a defined term for the operator of the Services. It does not mean that the business is a corporation or another registered company form.

We operate the Model Release App mobile applications (the “App”) and the Model Release App web application, as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

You can contact us by email at info@modelrelease.app or by mail to Schmidener Str. 216C, Stuttgart, BW 70374, Germany.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Aleh Hutnikau, concerning your access to and use of the Services.

You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are incorporated into these Legal Terms only where you have a fair chance to review them and where applicable law allows that incorporation.

We may change these Legal Terms from time to time. The “Last updated” date shows when this version was published. Changing that date records the revision. It is not, by itself, notice of a material change, and it is not, by itself, your acceptance of that change.

If we make a material change, we will take reasonable steps to tell you before the change takes effect, or when it takes effect, by email or by a notice in the Services, if we have a practical way to reach you. Whether that notice is sufficient, and whether continued use means you accept the change, depends on applicable law. Continued use does not override a mandatory right to reject a change, to end the contract, or to keep terms that the law requires us to keep.

If you do not agree to a change, stop using the Services. If you have a subscription, you can cancel it as described in section 6. Please also review these Legal Terms from time to time.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services. We recommend that you print a copy of these Legal Terms for your records.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

Nature of the Services

Model Release App provides software tools and pre-designed document templates, including model releases, property releases, and other agreements (collectively, “Templates”), to help you create, complete, sign, and manage documents. This includes Templates we provide and documents or templates you create or modify with the Services.

The Company is not a law firm and does not provide legal advice, legal representation, or legal opinions. Nothing provided through the Services constitutes legal advice or creates a lawyer-client relationship. Templates and related information are provided for general information and convenience only.

No Guarantee of Legal Validity or Suitability

We aim to provide useful and accurate Templates. We do not guarantee that any Template, or any document created through the Services, will be legally valid, enforceable, suitable for a particular purpose, or compliant with the laws and regulations of every jurisdiction.

Legal requirements may differ depending on the applicable jurisdiction, the intended use, the type of content, the parties involved, and the circumstances.

References to industry practice, third-party organizations, or particular document formats do not mean that a court, authority, marketplace, or other third party will accept a document, or that the document meets every legal requirement.

User Responsibility

You are responsible for:

  • Selecting an appropriate Template and determining whether it meets your needs and the legal requirements that apply.
  • Reviewing and, where necessary, modifying the document before you sign it or ask someone else to sign it.
  • Ensuring that the information in the document is accurate, complete, and lawful.
  • Verifying the identity, legal capacity, and authority of signatories where that is necessary.
  • Obtaining the permissions, consents, authorizations, and supporting documents that the situation requires, including those relating to minors, legal guardians, property rights, image rights, intellectual property, and privacy.
  • Ensuring that the electronic signing method and the documents generated through the Services meet the legal requirements that apply.

You should consult a qualified lawyer when you create or use a document that may have significant legal or financial consequences.

Electronic Signatures and Document Verification

The Services support electronic signatures, document generation, and verification. These features do not by themselves guarantee that an agreement is legally enforceable, that a signatory has been identified or has authority, or that every legal formality has been met. Section 22 explains this further.

Limitation of Responsibility

To the extent permitted by applicable law, the Company is not responsible for loss, claims, disputes, or other legal consequences arising from your selection, modification, completion, or use of a Template or generated document, including incorrect or incomplete information, missing permissions, or a failure to meet applicable legal requirements.

This limitation does not exclude or limit liability for the Company’s own conduct where the law does not allow that liability to be excluded or limited. It does not exclude or limit mandatory consumer rights, statutory remedies, or any other liability that cannot legally be excluded or limited. Section 19 is the liability framework for the Services, and it applies to this section.

2. Intellectual Property Rights

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”). Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.

You may use the Services for your personal use and for your commercial photography, video production, and related professional activities, as these Legal Terms allow.

Your use of our Services

Subject to your compliance with these Legal Terms, including the “PROHIBITED ACTIVITIES” section below, we grant you a non-exclusive, non-transferable, revocable license to:

  • access the Services; and
  • download or print a copy of any portion of the Content to which you have properly gained access.

You may create, sign, export, share, and use completed contracts and releases for legitimate commercial purposes. You may provide those documents to clients, stock photography agencies, production companies, and other relevant parties. A completed document may contain Template wording. Using that document for a real engagement, including sending it for signature, is allowed.

You may not sell, sublicense, publish, or otherwise distribute the standalone application, the software, or the proprietary template library as a product, or offer them as a substitute for the Services. Copying the template library in order to resell it, or to build a competing template or signing product, is not allowed.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited without our express prior written permission.

If you wish to make any use of the Services, Content, or Marks other than as set out in this section or elsewhere in our Legal Terms, please address your request to: info@modelrelease.app. If we ever grant you the permission to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owners or licensors of the Services, Content, or Marks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our Content.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

Your submissions

Please review this section and the “PROHIBITED ACTIVITIES” section carefully prior to using our Services to understand the (a) rights you give us and (b) obligations you have when you post or upload any content through the Services. Submissions: By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services (“Submissions”), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

You are responsible for what you post or upload: By sending us Submissions through any part of the Services you:

  • confirm that you have read and agree with our “PROHIBITED ACTIVITIES” and will not post, send, publish, upload, or transmit through the Services any Submission that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading;
  • to the extent permissible by applicable law, waive any and all moral rights to any such Submission;
  • warrant that any such Submission are original to you or that you have the necessary rights and licenses to submit such Submissions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions; and
  • warrant and represent that your Submissions do not constitute confidential information.

You are solely responsible for your Submissions and you agree to reimburse us for losses we suffer because of your breach of (a) this section, (b) any third party’s intellectual property rights, or (c) applicable law, to the extent permitted by applicable law. Sections 19 and 20 limit how far that reimbursement can go.

3. User Representations

By using the Services, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete
  • You will maintain the accuracy of such information and promptly update such registration information as necessary
  • You have the legal capacity and you agree to comply with these Legal Terms
  • You are not under the age of 13
  • you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services;
  • you will not access the Services through automated or non-human means, whether through a bot, script or otherwise;
  • you will not use the Services for any illegal or unauthorized purpose; and
  • your use of the Services will not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4.1 Account Usage and Device Limits

Each Model Release App subscription is intended for use by a single account holder, unless otherwise stated in the selected subscription plan.

To ensure fair use, security, and service reliability, Model Release App may limit the number of devices from which an account can be accessed within a given time period. The applicable device limits depend on the active subscription plan.

If the permitted device limit is exceeded, access from additional devices may be temporarily restricted until the applicable time window resets or the subscription is upgraded. Model Release App reserves the right to enforce such limits automatically.

5. Products

All products are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. Price changes and cancellation for subscriptions are described in section 6, and liability for a discontinuance is described in section 19.

6. Purchases and Payment

These terms apply to paid access to Model Release App, including subscriptions bought in the mobile applications or in the web application.

Subscriptions

Model Release App offers subscription plans. A subscription provides the paid features included in the plan you select, for that plan’s billing period. A subscription renews automatically at the end of each billing period unless you cancel it before renewal.

Where you can subscribe

  • Apple App Store. If you subscribe in the iOS app, Apple processes the payment. The purchase is also subject to Apple’s terms and policies.
  • Google Play. If you subscribe in the Android app, Google processes the payment. The purchase is also subject to Google’s terms and policies.
  • Web application. If you subscribe on the website or in the web application, Paddle processes the payment. Our Refund Policy states that Paddle is the merchant of record for website purchases. The purchase is also subject to Paddle’s terms and to our Refund Policy: https://modelrelease.app/pages/refund-policy/.

We do not control payment processing by Apple, Google, or Paddle. If a charge fails or a billing error occurs, contact the provider that processed the payment. You may also contact us at support@modelrelease.app, and we will help where we can.

Token purchases

Earlier versions of the mobile applications offered one-time token purchases, such as consumable token packages. Tokens do not renew. The current web application does not offer token purchases. If a token package is still available to you in an app store, or if you bought tokens before, the store that processed the purchase handles payment and refunds for that purchase, together with any mandatory right that applies. Any continued use of previously purchased tokens remains subject to these Legal Terms.

Pricing, currency, and taxes

The price shown at checkout is the price that applies to that purchase. Currency, regional pricing, and taxes depend on the platform and on your location. App Store and Google Play show their own prices. The web checkout shows the price and any taxes presented there.

We may change the price of a subscription. A change applies only to future purchases and to later renewals, and only as the relevant platform’s rules and applicable law allow. A price change does not apply retroactively to a billing period you have already paid for.

Automatic renewal, cancellation, and payment management

A subscription continues to renew until you cancel it. Cancellation stops later renewals. It does not, by itself, refund a payment already made.

  • Apple App Store. Manage and cancel the subscription in your Apple account settings.
  • Google Play. Manage and cancel the subscription in your Google Play account settings.
  • Web application. The subscription screen can open the cancellation and payment-method pages Paddle provides for that subscription. Paddle also includes cancellation instructions in the purchase confirmation email.

Refunds, withdrawal, and statutory rights

Our Refund Policy explains how to request a refund: https://modelrelease.app/pages/refund-policy/.

Nothing in this section removes a statutory right to withdraw, to a refund, or to another remedy where applicable law gives you that right. This includes mandatory consumer rights in the European Union and in Germany. Where Apple, Google, or Paddle must process the refund, you may need to use that provider’s process, as the Refund Policy explains.

For some digital services, a statutory withdrawal right can end earlier if the conditions set by applicable law are met, including any consent and acknowledgment the law requires. These Legal Terms do not take away a right that the law does not allow to be given up.

Authorization

By making a purchase, you confirm that:

  • You are legally entitled to use the chosen payment method, and the information you provide is correct and complete.
  • You authorize the provider that processes the purchase (Apple, Google, or Paddle) to charge you for that purchase and for renewals until you cancel.

If you do not agree with this section, do not buy a subscription or other paid feature.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. You may use the Services for legitimate commercial photography, filmmaking, video production, and related professional work. That use includes creating, signing, exporting, sharing, and using completed contracts and releases, and providing them to clients, stock photography agencies, production companies, and other relevant parties.

As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  • Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
  • Use any information obtained from the Services in order to harass, abuse, or harm another person.
  • Make improper use of our support services or submit false reports of abuse or misconduct.
  • Use the Services in a manner inconsistent with any applicable laws or regulations.
  • Engage in unauthorized framing of or linking to the Services.
  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Delete the copyright or other proprietary rights notice from any Content.
  • Attempt to impersonate another user or person or use the username of another user.
  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
  • Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
  • Use a buying agent or purchasing agent to make purchases on the Services.
  • Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  • Copy, resell, sublicense, or publicly redistribute the Services, the proprietary template library, or the software in order to compete with us or to provide a substitute product. This does not restrict the professional use of completed contracts and releases described above.
  • Use the Services as an advertising or spam platform for unrelated goods and services. This does not restrict you from using completed contracts and releases in your professional work.
  • Sell or otherwise transfer your profile.

8. User Generated Contributions

By using Model Release App, you can create content, including contracts, contract text, information about participants, and other data entered in a contract. These contributions are collectively referred to as “User Generated Contributions.” You retain ownership of the User Generated Contributions that you create, as section 9 describes, and you remain responsible for them.

Access and sharing

User Generated Contributions are not public by default. Who can see a document depends on your actions, the permissions of the account, and the workflow you use.

  • You can sign a document directly in the mobile or web application with the people taking part in that signing.
  • You can send a signature request by email. The recipient can open that signing link and see the document needed to review and sign it.
  • You can use Group Events and Invitation Links. A participant who joins a roster can enter their own details and sign the contract that applies to them. An Invitation Link does not give every participant access to every document in the event.
  • After a Group Event is fully signed, you can send the relevant completed documents to a participating creator. Those documents relate to that creator. They are not a copy of every document in the event.
  • You can export signed releases and certificates and give them to the people you choose, such as a client, agency, or production company.

A person receives access to the document or file that was shown, sent, or exported to them. We may access, store, and process User Generated Contributions as needed to provide the Services, as described in the Privacy Policy and section 9.

Content Responsibility

You affirm that all User Generated Contributions adhere to relevant laws and regulations. You are solely responsible for the content you create and for the legal consequences of how you use it. Section 1.1 and section 19 explain the limits of our responsibility.

Representations and Warranties

When you create or make available any Contributions, you thereby represent and warrant that:

  • The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
  • You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions in the manner contemplated by the Services and these Legal Terms, including the access described in this section 8.
  • You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Services and these Legal Terms.
  • Your Contributions are not false, inaccurate, or misleading.
  • Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
  • Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
  • Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
  • Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
  • Your Contributions do not violate any applicable law, regulation, or rule.
  • Your Contributions do not violate the privacy or publicity rights of any third party.
  • Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
  • Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
  • Your Contributions do not otherwise violate, or link to material that violates, any provision of these Legal Terms, or any applicable law or regulation.

Any use of the Services in violation of the foregoing violates these Legal Terms and may result in, among other things, termination or suspension of your rights to use the Services.

9. Contribution License

You agree that we may access, store, process, and use any information and personal data that you provide in order to provide the Services, following the Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding the Services, you agree that we can use and share such feedback for any purpose without compensation to you.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not responsible for statements or representations in your Contributions. You are responsible for your Contributions. This section does not require you to give up a claim that applicable law does not allow to be excluded, and it does not limit the liability described in section 19.

10. Mobile Application License

This section applies to the App. The web application is part of the Services and is licensed under section 2. Restrictions in this section that protect the software, the template library, and the security of the Services also apply to the web application. Professional commercial use is permitted as described in sections 2 and 7.

Use License

If you access the Services via the App, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, and to access and use the App on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Legal Terms. You shall not:

  • Except as permitted by applicable law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App;
  • Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App;
  • Violate any applicable laws, rules, or regulations in connection with your access or use of the App;
  • Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the App;
  • Use the App for a purpose for which it is not designed or intended, including reselling or redistributing the App or the proprietary template library. Using the App for commercial photography, video production, and related professional work is a purpose for which it is designed;
  • Make the App available to others as a hosted or redistributed service, or share your account in order to bypass the device limits in section 4.1. You may install and use the App on your own devices within those limits, and you may use the web application;
  • Use the App for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the App;
  • Use the App to send automated queries to any website or to send any unsolicited commercial email;
  • Use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the App.

Apple and Android Devices

The following terms apply when you use the App obtained from either the Apple Store or Google Play (each an “App Distributor”) to access the Services:

  • The license granted to you for our App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service;
  • We are responsible for providing any maintenance and support services with respect to the App as specified in the terms and conditions of this mobile application license contained in these Legal Terms or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the App;
  • In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App;
  • You represent and warrant that (i) you are not located in a country that is subject to a US government embargo, or that has been designated by the US government as a “terrorist supporting” country and (ii) you are not listed on any US government list of prohibited or restricted parties;
  • You must comply with applicable third-party terms of agreement when using the App, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the App;
  • You acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Legal Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these Legal Terms against you as a third-party beneficiary thereof.

11. Services Management

We reserve the right, but not the obligation, to:

  • Monitor the Services for violations of these Legal Terms;
  • Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities;
  • In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
  • Remove from the Services or otherwise disable files and content that are excessive in size or are in any way burdensome to our systems, where the law allows us to do so without prior notice;
  • Otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

Our liability for these steps is governed by section 19.

12. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy: https://modelrelease.app/pages/privacy-policy/. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. If these Legal Terms and the Privacy Policy conflict on a question of privacy, the Privacy Policy governs that question.

The Services use Google Firebase, including for data storage, user authentication, and related technical operations. Our cloud functions run in the United States (Google Cloud region us-central1). Service providers may process personal data in countries other than your own, including the United States. International transfers are described in the Privacy Policy. These Legal Terms do not add a separate claim that every part of the infrastructure is in one country, or that a particular transfer safeguard is in place, beyond what the Privacy Policy states.

Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personal information to us without the requisite and verifiable parental consent, we will delete that information from the Services as quickly as is reasonably practical.

13. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We may suspend or end access to the Services, including by blocking certain IP addresses, if you breach these Legal Terms or applicable law, or if we need to do so to protect the Services, other users, or our rights. We may suspend or terminate your account and delete content you posted.

Where mandatory law requires notice, a reason, or a refund, including for consumers and paid subscriptions, that law applies. Our liability for suspension or termination is governed by section 19.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

14. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. Our liability for a modification, price change, suspension, or discontinuance of the Services is limited as set out in section 19.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. Our liability for downtime or discontinuance is governed by section 19. This section does not exclude liability that section 19 preserves.

Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith. However, we assure you that should you wish to delete your account and all associated data, you may send a request through the application. Upon receiving such a request, we are obliged to fulfill it within 30 days, ensuring the complete removal of your information from our systems.

15. Governing Law

These Legal Terms are governed by and interpreted following the laws of Germany, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country of residence. Aleh Hutnikau and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Baden-Württemberg, which means that you may make a claim to defend your consumer protection rights in regards to these Legal Terms in Germany, or in the EU country in which you reside.

16. Dispute Resolution

If you have a complaint about the Services, please contact us at info@modelrelease.app. We will try to resolve it with you directly.

Section 15 describes which courts can hear a dispute. These Legal Terms do not require you or us to use arbitration, and they do not restrict a right to bring a claim in court.

The European Commission’s Online Dispute Resolution platform was discontinued on 20 July 2025. These Legal Terms do not refer you to that platform.

If a dispute with a consumer cannot be resolved directly, any information about a consumer conciliation body that the German Verbraucherstreitbeilegungsgesetz requires will be provided in text form.

17. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

18. Disclaimer

The Services are software tools and Templates for creating, completing, signing, and managing documents. Section 1.1 describes the Templates and the limits on what they are.

To the extent permitted by applicable law, we do not promise that the Services will be uninterrupted or error-free, and we do not promise that a Template or a document created with the Services will be legally valid, enforceable, suitable for a particular purpose, or accepted by any third party.

If you are a consumer, you keep the mandatory rights that apply to digital services and digital content, including rights that apply when the Services do not conform to the contract. We do not exclude those rights. Nothing in these Legal Terms excludes a statutory remedy that cannot legally be excluded.

We are not a party to the contracts you make with other people through the Services. We are not responsible for products or services offered by third parties, including app stores, payment providers, and websites linked from the Services, except to the extent the law makes us responsible for them.

This section does not exclude liability for injury to life, body, or health, for intent or gross negligence, or for any other liability that section 19 preserves.

19. Limitations of Liability

The following applies to the extent permitted by applicable law, including the rules on standard terms in the German Civil Code (Bürgerliches Gesetzbuch).

We are liable without limitation:

  • for damage caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit);
  • for injury to life, body, or health;
  • under the German Product Liability Act (Produkthaftungsgesetz), where it applies;
  • for breach of a guarantee we have separately given; and
  • for any other liability that cannot legally be excluded or limited.

If we cause other damage by ordinary negligence, we are liable only where we breach an essential contractual obligation (wesentliche Vertragspflicht). An essential contractual obligation is one that must be performed for the contract to be carried out properly and on which you ordinarily rely. In that case, our liability is limited to the foreseeable damage that is typical for this kind of contract.

We are not liable for other damage caused only by ordinary negligence.

These limits also apply to our legal representatives, employees, and agents where the law allows. They do not reduce mandatory consumer rights. They apply to section 1.1, to changes and interruptions described in section 14, and to loss or corruption of data described in section 21. They do not set a cap based on fees paid during a particular period.

If you are a consumer, you also keep any mandatory right under the law of your country of residence, as section 15 describes.

20. Indemnification

You agree to indemnify us against a third-party claim, including reasonable lawyers’ fees, to the extent the claim arises from:

  • your Contributions, or your selection, completion, or use of a Template or generated document;
  • your breach of these Legal Terms;
  • your breach of a representation in these Legal Terms;
  • your violation of a third party’s rights, including intellectual property rights; or
  • your unlawful conduct toward another person in connection with the Services.

You do not have to indemnify us to the extent the claim is caused by our intent, our gross negligence, or another matter for which section 19 does not allow us to exclude liability. If you are a consumer, this section applies only as far as mandatory consumer law allows, and only to the extent you are responsible for the claim.

We will use reasonable efforts to tell you if we become aware of a claim that this section covers. You will reasonably cooperate in the defense of a claim that you are responsible for. This section does not require you to pay the cost of defending liability that section 19 does not allow us to exclude.

21. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. We are committed to securing your data and utilize various safeguards to protect sensitive personal information. These measures include, but are not limited to:

  • Encryption: We use encryption to protect data in transit and at rest, ensuring that your information remains confidential and secure during transmission and storage.
  • Confidentiality and Integrity: We have implemented measures to maintain the ongoing confidentiality, integrity, availability, and resilience of our processing systems and services.
  • Access Controls: We restrict access to personal data to authorized personnel only, ensuring that your data is accessed strictly on a need-to-know basis.
  • Regular Security Audits: We perform regular security audits and assessments to identify potential vulnerabilities and address any security risks promptly.

Although we perform regular routine backups of data, you are responsible for keeping copies of documents you need to retain. Our liability for loss or corruption of data is governed by section 19. This section does not waive claims that section 19 preserves.

22. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms are electronic communications. You consent to receive electronic communications from us. You agree that agreements, notices, disclosures, and other communications we provide to you electronically, by email and on the Services, satisfy a legal requirement that the communication be in writing, where the law allows an electronic communication to satisfy that requirement. This does not remove a requirement that a particular notice be given in a form the law still requires.

The Services support electronic signatures. You can sign in the mobile or web application, and you can sign through a link sent by email. A completed document can include a record of the signing and a certificate that summarizes signing events and a cryptographic hash of the document. The certificate describes the signature used by the Services as a handwritten electronic signature. It is a record generated from information stored by the Services. It is not a statement that the signature meets every legal formality.

The legal effect of an electronic signature depends on the law that applies, the type of document, and the formalities that law requires. An electronic signature collected through the Services is not presented as a qualified electronic signature under the EU eIDAS Regulation. We do not state that every electronically signed document is enforceable in every jurisdiction, or that a court, authority, agency, or marketplace will accept it.

You are responsible for deciding whether you need further verification, a particular type of signature, or another formality. Section 1.1 applies to that decision.

Nothing in this section waives a mandatory right under applicable law, including a right that a document be signed or retained in a particular form where the law does not allow that requirement to be waived.

23. California Users and Residents

In accordance with California law, particularly the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have specific rights regarding their personal information. These rights include:

  • Right to Know: You have the right to request disclosure of certain information about our collection and use of your personal information over the past 12 months.
  • Right to Delete: You have the right to request the deletion of your personal information that we have collected and retained, subject to certain exceptions.
  • Right to Opt-Out of Sale or Sharing: California residents have the right to opt-out of the sale or sharing of their personal information to third parties. If you wish to exercise this right, please contact us: info@modelrelease.app
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of your CCPA/CPRA rights.

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

24. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. That limitation is subject to section 19.

If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. These Legal Terms may be made available electronically. Their electronic form does not, by itself, make them ineffective. This does not waive a mandatory right to challenge a term, including a right under consumer law.
